Disabilities Act

Reasonable modifications will be provided to afford a student with a disability meaningful access to the program, unless the District can demonstrate that the modification would be a fundamental alteration in the nature of the program, or constitute an undue financial and administrative burden.

The Kyrene School District requires users of District facilities to comply with the requirements of Section 504 of the Rehabilitation Act of 1973 and Title II of the American with Disabilities Act of 1990. Section 504 provides, “No qualified handicapped person, shall on the basis of handicap, be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any program or activity which receives benefits from Federal financial assistance.” See 29 USC 12131-12161, 29 CFR Part 35.

Students with disabilities who meet essential eligibility will be permitted to participate in the program. Any student, including students with disabilities, may be removed from a program if that student, even with reasonable modifications, is disruptive to the program such that other students cannot participate in the program or are put in danger. Signed Reasonable Accommodations Agreements are collected annually for students with disabilities to assist us in providing meaningful access to the program.

Student Therapy

Parents of students with disabilities, who receive services from the Division of Developmental Disabilities (DDD), may be able to schedule student therapy to occur during Preschool, Kids Club, and After Hours. Times services can be conducted will vary by program. During Non-School Days, services must be conducted between the hours of 7:00 a.m. and 6:00 p.m. Requests will be approved based on space/schedule availability.
